Terms & Conditions

1. GENERAL TERMS

1.1 By submitting an entry to the SharkNinja Home Upgrade Giveaway Competition (Competition), you acknowledge that you have read and agree to be bound by these Terms & Conditions and that the decisions of SharkNinja Pty. Ltd. ABN 87 147 260 197 trading as SharkNinja (the Promoter, we, us or our) as Promoter in connection with the Competition are final and you warrant that you satisfy all eligibility requirements set out in these Terms & Conditions. You also agree to the Promoter's Privacy Policy available on its website (see further clauses 12 and 13 below) which forms part of these Terms & Conditions.

1.2 The Competition is open to residents of Australia only who are 18 years or older at the time of entry. Employees of the Promoter, its respective parent, subsidiaries, affiliates, advertising and promotion agencies, distributors, and merchants involved with this Competition, along with their immediate family members and/or those living in the same household, are not eligible to enter or win. The Competition is governed by Australian law and subject to all applicable federal, state, and local laws and regulations, and is void where prohibited by applicable law.

1.3 The Competition is not available in conjunction with any other promotion or offer by the Promoter or any related body corporate.

1.4 Competition Period: The Competition commences at 12:01 AM AEST on 21 October, 2025 and closes at 11:59 PM AEST on 12 November, 2025 ("Competition Entry Period").

1.5 This Competition is conducted under relevant permits: NSW Permit No. NTP/14739, ACT Permit No. TP 25/02549, SA Permit No. T25/1841. Permits for other states/territories not required.

2. HOW TO ENTER

2.1 To enter the Competition, follow the instructions on the dedicated giveaway page giveaway.sharkclean.com.au/home-upgrade-giveaway to complete and submit the online entry form ("Primary Entry"). Upon completing your Primary Entry, you will be eligible for the Major Prize draws outlined in Section 3.1.

2.2 Wishlist Entry for Daily Draws: To be eligible for the Daily Winner draws, you must:

• Complete your Primary Entry on the main giveaway page at giveaway.sharkclean.com.au/home-upgrade-giveaway
• Create an account with Shark Clean and complete your wishlist by selecting your preferred Shark products at sharkclean.com.au/pages/wishlist and Ninja products at ninjakitchen.com.au/pages/wishlist using the same email address you used for your Primary Entry

Failure to use the same email address for both entries will result in disqualification from Daily Winner draws. Completing your wishlist does not affect your eligibility for Major Prize draws.

2.3 Survey-Based Additional Entries: Participants can earn additional entries by completing survey questions through their personalised status page after Primary Entry completion. These additional entries apply only to Major Prize draws and do not affect Daily Winner draws. The following opportunities for additional entries are available:

• +1 Entry - Answer This: What floor surfaces do you clean in your house regularly?

• +1 Entry - Answer This: Do you have a pet in your home?
• +1 Entry - Answer This: Describe the most difficult mess in the home you regularly face.
• +1 Entry - Answer This: Have you bought or considered buying any of our Shark Beauty hair styling products?
• +1 Entry - Answer This: What Ninja Kitchen products would you love to add to your collection? (Choose any that apply).
• +1 Entry - Answer This: How often do you cook at home?
• +1 Entry - Answer This: What kitchen appliances do you use most often? (Choose all that apply).
• +1 Entry - Answer This: What type of food do you wish you could cook but don't have the right tools?
• +1 Entry - Answer This: How many people do you usually cook for?
• +1 Entry - Answer This: How big is your kitchen bench space?

2.4 Referral Entries: Participants can earn additional entries by referring friends to enter the Competition through their unique referral link provided after Primary Entry completion. Each verified referral (friend who successfully completes Primary Entry using your referral link) will earn the referring participant three (3) additional entries into the Random Draw Major Prize competition. The 10 participants who generates the most verified referrals during the Competition Entry Period will automatically win one Major Prize (see Section 3.1 for details of the Major Prize).

2.5 To be valid, all entries must comply with, and be received in accordance with, these Terms & Conditions between 12:01 AM AEST on 21 October, 2025, and 11:59 PM AEST on 12 November, 2025 ("Competition Entry Period"). Online participants are subject to all notices posted online, including but not limited to the Promoter's Privacy Policy.

2.6 The Promoter reserves the right, in its sole discretion, to refuse to accept entries which are incomplete, indecipherable, offensive, do not comply with these Terms & Conditions or which contravene any applicable laws or regulations. The Promoter reserves the right to verify the eligibility of entries and disqualify any entries found to be fraudulent, duplicate, or in violation of these terms. The Promoter will verify that Primary Entry email addresses match wishlist account email addresses for Daily Winner eligibility.

2.7 Referrals must be genuine and verifiable. The Promoter reserves the right to disqualify referrals that appear fraudulent, including but not limited to fake email addresses, duplicate entries from the same household, or entries that cannot be verified as genuine referrals.

3. PRIZES & APPROXIMATE RETAIL VALUES ("ARV")

Total Prize Pool: $196,000 AUD inclusive of GST

3.1 Major Prizes

Major Prize Winner #1 - Random Draw: One winner selected by random draw will receive:

• $5,000 AUD product credit redeemable for any Shark or Ninja products at sharkclean.com.au and ninjakitchen.com.au
• Home Upgrade Fund: $5,000 AUD cash prize
• Total Individual Value for Major Prize Winner #1 - Random Draw: $10,000 AUD

Major Prize Winner #2 - Referral Champion: The participants who generate the top 10 most verified referrals during the Competition Entry Period will receive:

• $5,000 AUD product credit redeemable for any Shark or Ninja products at sharkclean.com.au and ninjakitchen.com.au
• Home Upgrade Fund: $5,000 AUD cash prize
• Total Individual Value for Major Prize Winner #2 - Referral Champion: $10,000 AUD

Total Value for All Major Prizes: $150,000 AUD

3.2 DAILY WINNERS (23 Winners - October 21 - November 12, 2025)

Each day during the Competition Entry Period (October 21 - November 12, 2025), one participant who has completed both their Primary Entry and wishlist entry using the same email address will be randomly selected to win $2,000 AUD in product credit redeemable for any Shark or Ninja products at sharkclean.com.au and ninjakitchen.com.au.

Total Value for Daily Winner Prize: $46,000 AUD (23 winners x $2,000 AUD)

3.3 PRIZE SPECIFICATIONS

• Product Credit Terms:
  • All product credits ($5,000 AUD for each Major Prize winners and $2,000 AUD for each Daily Winners) must be redeemed within 12 months from the date of issue
  • Product credits can be used to purchase any Shark or Ninja products available on sharkclean.com.au and ninjakitchen.com.au
  • Winners may purchase products for themselves, family, friends, or anyone else of their choosing
  • Product credits are non-transferable and cannot be exchanged for cash
  • Any unused credit balance after 12 months will be forfeited
  • Product credits will be issued digitally and can be applied to multiple orders until the full value is redeemed or expires
• Home Upgrade Fund: $5,000 AUD cash payment, to be spent at the winner's complete discretion.

3.4 Winners will be notified within 7 days of the relevant draw via the email address provided to the Promoter, and may be asked to provide contact details including a delivery address. It is the responsibility of winners to check their email to determine if they have won a Prize, and to respond to requests for information.

If a winner cannot be contacted or does not respond to the Promoter’s request for information relating to collection of the winner’s Prize within 14 days of contact that winner will forfeit their Prize and an alternate winner may be selected using the same method as the original winner selection. The Promoter will not be liable to participants for any forfeited Prizes.

3.5 Prizes are non-transferable, non-exchangeable, and not redeemable for cash except where specifically stated (Home Upgrade Fund prize). Prizes must be taken as awarded and no compensation will be paid if a winner is unable to use any component of their prize. Each participant is eligible to win a maximum of one (1) Major Prize (either through Random Draw or Referral Champion, whichever occurs first) and one (1) Daily Winner prize during the Competition Entry Period.

4. ODDS

4.1 Odds of winning depend on the total number of eligible entries received during the Competition Entry Period for Major Prizes, and the total number of eligible participants who have completed both Primary Entry and wishlist entry using matching email addresses for Daily Winners. Daily Winner draws are conducted equally among all eligible participants, with no additional entries applied. All prize draws are conducted randomly and are final with no correspondence entered into.

4.2 Major Prize Winners #1 will be selected by random draw from all eligible entries. Major Prize Winners #2 are determined by verified referral count (highest number wins). Daily Winners are selected randomly from all eligible participants who have completed both Primary Entry and wishlist entry with matching email addresses.

5. WINNER SELECTION & NOTIFICATION

5.1 DAILY WINNER SELECTION

Daily winners will be selected by random draw each day from October 21 - November 12, 2025, at 2:00 PM AEST from all participants who have completed both their Primary Entry and wishlist entry using the same email address by 11:59 PM AEST on the previous day of the random draw day at the Promoter’s office in Sydney, Suite 23.02, Level 23, 45 Clarence Street, Sydney, NSW 2000, Australia. The first daily draw will occur on October 22, 2025, from all eligible entries received by October 21, 2025. Daily draws will continue thereafter from all eligible entries received by 11:59 PM AEST on the previous day of the random draw day.

5.2 MAJOR PRIZE WINNER SELECTION

Major Prize Winners #1 (Random Draw): Will be selected by random draw on November 14, 2025, at 10:00 AM AEST at the Promoter’s office in Sydney, Suite 23.02, Level 23, 45 Clarence Street, Sydney, NSW 2000, Australia, from all eligible entries received during the Competition Entry Period.

Major Prize Winners #2 (Referral Champion): Will be determined by verified referral count as of 11:59 PM AEST on November 12, 2025. The participants with the highest number of verified referrals will be declared the winner. In the event of a tie, a random draw will determine the winner from tied participants.

5.3 WINNER NOTIFICATION

All winners will be notified by email within 7 days of the draw using the contact details provided in their entry. Winners must respond to notification within 14 days of initial contact attempt. It is each winner's responsibility to ensure their contact details are current and to comply with the Promoter's prize claim instructions.

5.4 UNCLAIMED PRIZES AND REDRAW

If any winner cannot be contacted or does not respond within the specified timeframe, their prize will be forfeited and a redraw will be conducted on December 15, 2025, at 10:00 AM AEST at the Promoter’s office in Sydney, Suite 23.02, Level 23, 45 Clarence Street, Sydney, NSW 2000, Australia. Winners of redraw will be notified by email within 7 days of the redraw using the contact details provided in their entry, and must respond within 14 days of initial contact attempt. There will be no further redraw for prizes still unclaimed.

5.5 WINNER ANNOUNCEMENT

Winner details will be announced via the Promoter's email database and social media platforms for the Shark® and Ninja® brands in Australia. Winners details including last name, first name and postcode will be published within 30 days of the Major Prize draw on the Competition website: https://giveaway.sharkclean.com.au/home-upgrade-giveaway. If required, winners details including last name, first name and postcode will be published within 30 days of the Unclaimed Prizes redraw on the Competition website: https://giveaway.sharkclean.com.au/home-upgrade-giveaway. All winners consent to their names being published on the social media platforms for the Shark® and Ninja® brands in Australia, and on the Competition website.

6. PRIZE DELIVERY & FULFILMENT

6.1 Major Prize fulfilment will commence in November 2025. Daily Winner prize fulfilment will occur within 14 business days of winner verification and confirmation.

6.2 Home Upgrade Fund Payment: The $5,000 AUD cash component will be paid by electronic funds transfer to the winner's nominated Australian bank account within 30 business days of winner verification and completion of required documentation.

6.3 Product Credit Issuance: Product credits will be issued digitally within 14 business days of winner verification. Winners will receive instructions on how to redeem their credit at sharkclean.com.au and ninjakitchen.com.au. All product credits must be redeemed within 12 months from the date of issue or they will expire and be forfeited.

6.4 The prize delivery timeframe provided in Clause 6.1-6.3 is indicative only and the Promoter is not responsible for delays in prize delivery due to circumstances beyond its reasonable control, including but not limited to product availability, shipping delays, or winner availability.

6.5 If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.

7. ADDITIONAL TERMS

7.1 Winners may be requested to participate in promotional activities related to the Competition as reasonably requested by the Promoter, including but not limited to photography, video content, and testimonials.

7.2 Winners are responsible for any taxes, fees, or other costs associated with prize acceptance and use not expressly covered in these terms.

7.3 Entry and acceptance of prizes constitutes permission to use the winner's name, likeness, city of residence, and entry content in all publicity activities relating to the Competition without further compensation, except where prohibited by law.

7.4 To the maximum extent permitted by law, the Promoter takes no responsibility for prizes being damaged, lost, or stolen after delivery to the winner.

7.5 Except to the extent required by law, including the Australian Consumer Law, the Promoter makes no warranties about the fitness for purpose or suitability of any prize and will not accept responsibility for the quality or fitness of any prize.

7.6 Email Verification: Daily Winner eligibility requires that the email address used for Primary Entry exactly matches the email address used to create the wishlist account. The Promoter will verify email address matching before awarding Daily Winner prizes.

8. LIABILITY & INDEMNITY

8.1 Except for liability that cannot be excluded by law, the Promoter excludes all liability (including negligence) for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition or any prize including, but not limited to that arising out of the following:

• any technical difficulties or equipment malfunction (not under the Promoter’s control), including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website or software failure;
• acts or omissions (including negligent acts or omissions) of the Promoter's employees, agents or third parties involved in the conduct of this Competition, with the exception of any wilful misconduct or fraud of the Promoter’s employees;
• any third party interference or unlawful act;
• any loss or damage to any computer related to or resulting from participation in this Competition, downloading any materials in connection with the Competition or use of a prize, including loss arising from a security breach, theft or destruction;
• any conduct or event that is beyond the reasonable control of the Promoter;
• any variation in the value of a prize or the prize pool from the value stated in these Terms, after the date of first publication of these Terms; and
• any receipt, taking, acceptance or use of a prize.

8.2 Participants acknowledge that they enter the Competition at their own risk and agree to indemnify the Promoter against any claims, costs, or expenses arising from their participation.

9. SOCIAL MEDIA TERMS

9.1 If participation in the Competition is via Facebook, Instagram, or other social media platforms, participants agree to act in accordance with the applicable platform's Terms and Conditions and acknowledge that the Competition is not sponsored, endorsed, or administered by these platforms.

9.2 Participants agree to grant these platforms complete release from any claims related to the Competition and acknowledge that any information provided is to the Promoter, not the social media platforms.

10. GOVERNING LAW

10.1 This Competition is governed by the laws of New South Wales, Australia. All entrants shall submit to the non-exclusive jurisdiction of the Courts of New South Wales, including any courts that hear appeals from those courts.

12. PRIVACY & MARKETING COMMUNICATIONS

12.1 By entering this Competition, participants consent to the Promoter collecting, using, and handling their personal information for Competition administration, prize fulfilment, and marketing purposes in accordance with the Promoter's Privacy Policy.

12.2 Personal information may be used for promotional purposes for both Shark® and Ninja® brands, including marketing communications, unless participants opt-out.

13. PRIVACY POLICY - YOUR PRIVACY

We are committed to protecting your privacy as an online visitor and Competition participants. We use collected information to maximise our services and adhere to Australian Privacy Principles.

INFORMATION COLLECTION & USE

The Promoter collects personal information from participants for the purposes of the conduct of this Competition and for future promotional, marketing and publicity purposes, including to contact participants to provide information about special offers or other marketing materials via any medium. Participants consent to the collection, storage and use of their personal information for these purposes.

STORAGE AND SECURITY

All customer information is protected by secure servers with encryption. We implement reasonable security measures and regularly update them according to current technologies and applicable law.

COOKIES

Our website uses cookies to enhance user experience and collect browsing behaviour information. Cookies do not access personal information stored on your device.

DISCLOSURE

We may disclose personal information to comply with legal requirements, protect rights and safety, or in business transactions under confidentiality agreements. We do not sell personal information to third parties.
